Conditions of participation in harry's home competitions

Participation in the competition of Harry’s Home Holding AG, hereinafter referred to as the operator or organizer, is free of charge and is governed exclusively by these conditions of participation.

Subject of the conditions of participation and organizer

(1) These conditions of participation regulate the conditions for participation in the competition and any necessary transfer of rights. The description and the procedure of the respective competition will take place as part of the respective competition campaign on the social media channels of harry’s home hotels & apartments.

(2) The organizer of the competition is Harry’s Home Holding AG.

(3) By participating in the respective competition, these conditions of participation are accepted.

(4) The competition is not connected to Instagram or Facebook, it is neither sponsored, supported nor organized by Instagram or Facebook.

Participation

By participating in the competition, the participant accepts these conditions of participation. Participation in the competition takes place via participation on the respective social media channel. The conditions of participation, the duration of participation, the prizes and information on how to win can be found in the competition description on the respective social media channel. Participation is only possible within the participation period. Participation in the competition is free of charge.

Eligible participants

(1) Natural persons who are resident in Germany, Austria, Switzerland or Italy and have reached the age of 14 are eligible to participate. Participation with fake identities or with identities of third parties is not permitted.

(2) All persons involved in the conception and implementation of the competition and all employees of the company are not eligible to participate in the competition.

(3) Eligible participants can take part in the competition by following/responding to the instructions in the respective post and by following the Instagram or Facebook page of harry’s home hotels & apartments and leaving this rating until the winners are selected.

(4) The duration of the sweepstakes extends from 1.12.2021 to 24.12.2021. During this period, users will have the opportunity to participate in the sweepstakes online.

Prizes and notification of winnings

(1) The winner will be determined after the closing date for entries as part of a random draw among all participants. The winner of the prize draw will be informed of the prize promptly via direct message. The prize will be handed over by e-mail.

(2) If we do not receive a reply from a winner within one week of notification, the claim to the prize expires. In this case, we are entitled to carry out a replacement draw.

(3) Exchange, self-collection and cash payment of the prize are not possible.

(4) If circumstances arise for which we are not responsible, the respective winner shall accept an appropriate substitute prize. Such circumstances for which we are not responsible are in particular those that lie with the sponsors of the prizes.

Granting of rights of use

By accepting the prize, the winner agrees that we may use his/her name for advertising purposes. Furthermore, the winner grants his/her personal rights for a winning photo without restriction in terms of time and space.

Applicable law

The competition is subject exclusively to Austrian law.

Termination of the competition

The organizer expressly reserves the right to terminate the competition without prior notice and without giving reasons. This applies in particular to any reasons that would disrupt or prevent the competition from running as planned.

Disclaimer

Harry’s Home Holding AG is not liable for damages in connection with participation in the competition or with the acceptance and use of the prize, unless the competition provider or its vicarious agents act with intent or gross negligence. This does not affect any claims for compensation due to injury to life, limb and health as well as material contractual obligations.

Data protection

Personal data must be provided in order to take part in the competition. The participant assures that the personal details provided by him/her, in particular first name, surname and email address, are true and correct.

The organizer points out that all personal data of the participant will neither be passed on to third parties nor given to them for use without consent.

In the event of a win, the winner agrees to the publication of his/her name and place of residence in the advertising media used by the organizer. This includes the announcement of the winner on the operator’s website and its social media platforms.

The participant can revoke his/her declared consent at any time. The revocation must be sent in writing to the organizer’s contact details given in the legal notice section of the competition app. Once consent has been withdrawn, the participant’s personal data that has been collected and stored will be deleted immediately.

Severability clause

Should a provision of the conditions of participation be or become invalid, this shall not affect the validity of the remaining provisions. In such a case, the organizer and participants are obliged to cooperate in the creation of provisions that come as close as possible to the economic result of the invalid provision.
